Migration Queensland – Updated 190 and 491 Visa Criteria

If you have been nominated for, applied for, or currently hold a Skilled Work Regional (Provisional) visa (subclass 491), Migration Queensland will not nominate you for the Skilled Nominated (Permanent) visa (subclass 190).

In cases where you are eligible for both the 190 and 491 visas, ensure to submit a single Expression of Interest (EOI) and select both visa classes. Avoid submitting multiple EOIs, as only the first one in the queue will be considered, and the rest will be closed. You will receive only one invitation.

For businesses seeking nomination, it is imperative to have a physical office in Queensland; virtual offices will not be accepted.

Upon invitation from Migration Queensland to lodge an application, you will receive copies of the State Nomination Application and Settlement Funds Declaration form.

If you possess more than one skills assessment, kindly submit only one EOI for the occupation that best aligns with your current employment.

Before submitting your application, ensure thorough reading of the application process, document checklist, and all explanatory notes provided below.

Invitations will not receive priority based on expiring documents or visas.

For individuals employed through a labour hire provider, it is essential that the provider is licensed to operate in Queensland under the Labour Hire Licensing Act 2017. This requirement applies to all labour hire providers, including those based interstate or overseas, who supply workers within Queensland. Evidence of compliance with these licensing requirements from your labour hire provider will be necessary.
